This User Fulfillment Policy (“Policy”) explains how Freshly Inked (“Freshly,” “we,” “our,” or “us”) fulfills services for individuals seeking tattoo artists or viewing artist profiles on FreshlyInkedMag.com (the “Platform”). By using the Platform as a tattoo client (“Client,” “you,” or “your”), you acknowledge and agree to the terms below.
1. Nature of Freshly Inked’s Services
Freshly Inked is a digital platform that allows Clients to:
- Browse artist profiles and portfolios
- Discover tattoo artists and styles
- Submit basic inquiries through artist storefronts
Freshly Inked is not a tattoo studio, booking service, payment processor, or scheduling platform.
All tattoo services, pricing, communication, scheduling, deposits, and agreements are handled independently between Clients and Artists.
2. Fulfillment of Platform Services
Client-facing services are considered fully delivered when:
- You access artist profiles and content on the Platform;
- You submit an inquiry through an artist’s storefront (if provided); or
- You receive automated confirmation that your inquiry was sent.
Freshly Inked does not guarantee that an Artist will respond or accept your inquiry.
3. Freshly Inked Is Not Involved in Tattoo Transactions
Freshly Inked does not participate in or guarantee any part of the tattoo process. This includes but is not limited to:
- Booking appointments
- Setting prices or quotes
- Communicating with Artists
- Managing deposits or payments
- Providing refunds for tattoo services
- Handling disputes or dissatisfaction
- Managing no-shows, cancellations, or rescheduling
All transaction terms are strictly between the Client and the Artist.
4. No Guarantee of Artist Availability or Quality
Freshly Inked does not guarantee:
- That an Artist will respond to your inquiry
- That an Artist is available for new bookings
- The quality of tattoo work or outcomes
- That photos, descriptions, or portfolios are accurate or up-to-date
Freshly does not endorse or verify Artist claims, experience, or skill level unless explicitly stated.
5. No Responsibility for Tattoo Outcomes
By using the Platform, you acknowledge that tattoo services carry inherent risks, including but not limited to:
- Infection, irritation, allergic reactions
- Skin complications, scarring, or improper healing
- Dissatisfaction with design, placement, or quality
Freshly Inked is not liable for any injury, dissatisfaction, medical issue, or negative outcome resulting from tattoo services performed by an Artist.
Freshly Inked does not provide medical advice or evaluate the safety of any procedure.
6. No Refunds Through Freshly Inked
Freshly Inked does not issue refunds for:
- Tattoo deposits or payments
- Canceled appointments
- Dissatisfaction with the tattoo received
- Lack of response from an Artist
- Miscommunication or disagreements with an Artist
Refunds, disputes, and service concerns must be handled directly with the Artist.
7. Client Responsibilities
Clients are responsible for:
- Researching Artists and reviewing their qualifications
- Discussing pricing, deposits, expectations, and design directly with the Artist
- Following all aftercare instructions provided by the Artist
- Ensuring the tattoo studio meets safety and hygiene expectations
Freshly Inked does not verify artist license status, insurance, or health standards.
8. Platform Downtime & Accessibility
Freshly Inked may occasionally undergo updates or maintenance that limit your ability to browse artist profiles. Such downtime does not constitute a failure of service or grounds for compensation.
9. No Warranty or Guarantee of Results
Freshly Inked does not warrant that:
- You will find an Artist suited to your needs
- You will receive a response from an Artist
- Your tattoo experience will meet expectations
10. Limitation of Liability
To the maximum extent permitted by law, Brookline Holdings, LLC d/b/a Freshly Inked is not responsible or liable for:
- Any tattoo performed by an Artist discovered through the Platform
- Any injury, infection, allergic reaction, or medical complication
- Any dissatisfaction, artistic differences, or undesired outcomes
- Any deposit disputes, cancellations, or payment losses
- Any communication or contractual issues with an Artist
