Artist Fulfillment Policy

This Artist Fulfillment Policy (“Policy”) explains how Freshly Inked (“Freshly,” “we,” “our,” or “us”) delivers digital services, fulfills subscription benefits, and manages expectations related to the artist platform hosted at FreshlyInkedMag.com (the “Platform”). This Policy applies to all artists, studios, and creative professionals (“Artist,” “you,” or “your”) who subscribe to or use the Platform.

1. Nature of Services

Freshly Inked provides digital-only services that support brand-building, visibility, and professional presentation for artists. These services include:

  • Hosted digital storefront
  • Portfolio and content display tools
  • Artist profile creation and editing
  • Client inquiry and message reception tools
  • Optional editorial exposure and promotional opportunities
  • Access to an admin dashboard and artist tools

These services are not physical products, do not involve in-person work by Freshly Inked, and are considered digitally delivered immediately upon subscription activation.

2. Service Fulfillment

Freshly Inked’s digital services are deemed fully fulfilled when:

  • Your subscription payment is successfully processed;
  • You receive access to the artist dashboard;
  • You have the ability to create, edit, and publish your artist storefront; and
  • Your storefront and included features within your subscription tier are available for use.

Freshly Inked is not responsible for:

  • Uploading your content or completing your profile on your behalf;
  • Custom design work unless separately contracted;
  • Guaranteeing traffic, inquiries, or sales to your storefront.

3. Artist Responsibilities

To ensure successful fulfillment, Artists are responsible for:

  • Uploading accurate and complete profile information;
  • Maintaining updated portfolio images, pricing, and service details;
  • Ensuring all content is legal, owned by the Artist, and non-infringing;
  • Managing client communication, scheduling, deposits, and agreements independently;
  • Providing a safe, lawful tattooing environment; and
  • Complying with all local, state, and federal regulations.

Freshly Inked does not verify artist credentials, licenses, safety compliance, or insurance.

4. No Involvement in Tattoo Transactions

Freshly Inked is not a booking service or tattoo marketplace. Freshly Inked does not:

  • Take a percentage of tattoo deposits or payments;
  • Handle refunds, cancellations, or rescheduling for tattoo services;
  • Communicate with clients on your behalf;
  • Set your prices or negotiate with clients for you; or
  • Guarantee client attendance, conduct, or satisfaction.

All financial, scheduling, and customer service matters are exclusively between you and your clients.

5. Digital Delivery and Non-Refundable Fulfillment

Because platform access is delivered instantly upon subscription activation:

  • All subscription fees become earned and non-refundable at the time of payment;
  • Artists are responsible for using the tools provided;
  • Lack of usage does not indicate lack of fulfillment; and
  • Failure to upload content or complete your storefront does not constitute non-delivery.

Refund exceptions may apply only in cases of verified billing errors caused directly by Freshly Inked, as further described in the Refund & Cancellation Policy.

6. Downtime, Updates, and Modifications

Freshly Inked may perform routine maintenance, apply updates, or make changes to the Platform. During these periods, temporary outages or feature adjustments may occur. Artists are not entitled to refunds or credits due to:

  • Temporary downtime;
  • Feature changes, improvements, or redesigns; or
  • Platform modifications that do not fundamentally prevent access to your account.

7. No Guarantees or Performance Promises

Freshly Inked does not guarantee:

  • A specific number of profile visits, inquiries, or bookings;
  • Any increase in sales, revenue, or social media metrics; or
  • Any particular business outcome or performance result.

The Platform provides tools; outcomes depend entirely on the Artist’s content, reputation, responsiveness, and external market conditions.

8. Chargebacks

If an Artist initiates a chargeback for subscription fees:

  • Access to the Platform may be immediately revoked;
  • The Artist may be permanently banned from future use;
  • Freshly Inked reserves the right to dispute the chargeback using evidence of service delivery; and
  • The Artist may be responsible for any chargeback fees assessed to Freshly Inked.

9. Termination

Freshly Inked may terminate or suspend an Artist’s access to the Platform for:

  • Violations of this Policy or the Terms of Service;
  • Fraudulent, unsafe, or abusive conduct;
  • Chargebacks or unresolved payment disputes; or
  • Misuse of the Platform or harm to other users.

Terminated accounts are not eligible for refunds.
