This Client Liability Waiver & Risk Disclosure (“Waiver”) applies to all individuals (“Client,” “you,” or “your”) who use FreshlyInkedMag.com (the “Platform”) to discover or communicate with tattoo artists (“Artists”). By using the Platform, you acknowledge and agree to the following terms and accept full responsibility for any tattoo services you choose to receive.
1. Platform Role & No Liability
Freshly Inked is a digital directory and promotional platform. Freshly Inked does not perform tattoos, employ tattoo artists, or supervise tattoo services.
You acknowledge and agree that Freshly Inked:
- Does not guarantee the safety, skill, licensing, or professionalism of any Artist
- Does not inspect, monitor, or control tattoo procedures or studio environments
- Is not responsible for the actions or omissions of any Artist
- Is not liable for any tattoo-related injury, infection, allergic reaction, complication, or dissatisfaction
Your decision to contact or book with an Artist is made entirely at your own risk.
2. Assumption of Risk
Tattooing involves inherent physical risks. By proceeding with any tattoo service from an Artist discovered through the Platform, you voluntarily assume all risks, including but not limited to:
- Infection, irritation, or inflammation
- Allergic reactions to ink or materials
- Scarring, keloids, or skin damage
- Bleeding or physical discomfort
- Improper healing or adverse reactions
- Dissatisfaction with design, placement, or artistic outcome
- Need for medical treatment or correction
You understand and accept that these risks may occur even when tattoos are properly performed under sanitary conditions.
3. No Medical Liability
Freshly Inked does not provide medical advice and does not evaluate the medical suitability of Clients for tattoo procedures.
You acknowledge that:
- You are solely responsible for consulting a doctor if you have health concerns
- You are responsible for disclosing any allergies or medical issues to the Artist
- Freshly Inked has no responsibility for post-tattoo complications or treatment
4. No Responsibility for Transactions or Agreements
Freshly Inked is not a tattoo booking service, payment processor, or dispute mediator. Freshly Inked does not participate in:
- Pricing, quotes, or payment terms
- Deposits, refunds, or cancellations
- Scheduling or rescheduling appointments
- Contract or agreement formation between Client and Artist
- Resolving disputes, dissatisfaction, or communication issues
All financial transactions are solely between you and the Artist.
5. No Guarantee or Endorsement of Artists
Artists listed on the Platform are independent professionals. Freshly Inked does not:
- Guarantee availability, responsiveness, or booking acceptance
- Verify licensing, insurance, compliance, or sanitation practices
- Guarantee the truthfulness of Artist-provided information or images
- Endorse any Artist unless clearly stated
6. Release of Claims
To the fullest extent permitted by law, you hereby release and discharge Brookline Holdings, LLC d/b/a Freshly Inked, its owners, employees, contractors, and affiliates from any and all claims, damages, liabilities, injuries, losses, or expenses arising from:
- Your communication or interaction with any Artist
- Your decision to obtain a tattoo from any Artist
- Any tattoo procedure, outcome, or aftercare complications
- Any dissatisfaction with artwork, service, or communication
- Any acts or omissions of the Artist
This release applies even if an Artist was discovered, promoted, or displayed on the Platform.
7. Indemnification
You agree to indemnify and hold harmless Freshly Inked from any claims or demands arising from your actions, agreements, or interactions with an Artist, including any legal fees incurred defending such claims.
8. Client Responsibilities
By using the Platform, you agree that it is your sole responsibility to:
- Research the Artist and verify their credibility and licensing
- Discuss safety, pricing, expectations, and design before booking
- Follow all aftercare instructions provided by the Artist
- Seek medical advice if any concerns arise
