Freshly Inked Artist Subscription Platform
Last Updated: December 8, 2025 These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Artist,” “you,” or “your”) and Brookline Holdings, LLC, d/b/a Freshly Inked, (“Freshly,” “we,” “our,” or “us”) governing your subscription and use of the artist services offered at FreshlyInkedMag.com (the “Platform”). By subscribing to or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. DEFINITIONS
Artist: Any individual or business subscribing to and using the Platform to host an artist profile or storefront. Platform: FreshlyInkedMag.com and all related features, services, tools, and functionality. Content: Any materials uploaded by the Artist, including images, videos, text, artwork, and branding assets. Client: Any individual viewing your profile or contacting you through the Platform.
2. DESCRIPTION OF SERVICES
Freshly provides subscription-based tools that allow Artists to:
- Create and maintain an artist storefront
- Display portfolios, merchandise, and biography information
- Receive inquiries from Clients
- Manage public reviews
- Participate in editorial and promotional opportunities at Freshly’s discretion
Freshly is not a tattoo booking service and does not participate in your tattoo transactions.
3. NO COMMISSION ON TATTOO SERVICES
Freshly does not take a percentage, commission, fee, or share of:
- Tattoo deposits
- Tattoo session payments
- Consultation fees
- Cancellations, no-shows, or reschedules
- Any in-person tattoo-related transactions
Artists maintain 100% ownership and revenue of all tattoo-related income.
4. ARTIST RESPONSIBILITY FOR CLIENT RELATIONSHIPS
Artists are solely responsible for all interactions and communications with Clients. Freshly is not responsible for:
- Contacting Clients
- Scheduling or confirming appointments
- Sending reminders
- Managing cancellations or no-shows
- Price negotiations or quotes
- Approving Client-submitted information
5. DISPUTES, REFUNDS & CHARGEBACKS
Freshly is not a party to any agreement between the Artist and Client. Freshly bears no responsibility for:
- Payment disputes
- Chargebacks
- Refunds or partial refunds
- Quality-of-work concerns
- Client dissatisfaction
- Failed appointments or miscommunication
6. REVIEWS AND PUBLIC FEEDBACK
The Platform may allow Clients to leave ratings and feedback. Artists acknowledge:
- Freshly does not control or pre-screen reviews
- Reviews may be positive, negative, or neutral
- Freshly does not remove reviews unless they violate guidelines
- Freshly is not liable for reputational harm from reviews
7. SUBSCRIPTION FEES & BILLING
- Fees are charged on a recurring basis
- Subscriptions renew until canceled
- Failure to pay may result in suspension
- Fees are generally non-refundable
8. CONTENT OWNERSHIP & LICENSE
You retain ownership of your Content. You grant Freshly a non-exclusive, worldwide license to:
- Display your Content on your profile
- Use your Content in promotional materials related to the Platform
9. ARTIST CONDUCT & COMPLIANCE
You agree to:
- Comply with all tattooing laws and regulations
- Maintain licenses, permits, and insurance
- Provide accurate profile information
- Not engage in illegal activity through the Platform
10. WARRANTY DISCLAIMER
The Platform is provided “as is” and “as available.” Freshly does not warrant that:
- The Platform will be error-free
- You will receive bookings or sales
- The service will meet business expectations
11. LIMITATION OF LIABILITY
Freshly is not liable for:
- Lost income or business
- Client behavior or actions
- Negative reviews
- Disputes, refunds, or chargebacks
- Injuries or claims arising from tattoo services
- Technical issues or data loss
Freshly’s maximum liability is limited to the amount paid by the Artist in the preceding twelve (12) months.
12. INDEMNIFICATION
You agree to defend and indemnify Freshly against claims arising from:
- Your tattoo services
- Your Client interactions
- Your Content
- Your violation of these Terms
13. TERMINATION
Freshly may suspend or terminate your account for violations. You may cancel at any time. Cancellations do not guarantee refunds.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Florida.
15. ENTIRE AGREEMENT
These Terms represent the entire agreement between Freshly and the Artist.
16. MODIFICATIONS TO TERMS
Freshly may modify these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
